Sisters and Brothers,

 Sister Linda Greenwood has prevailed in a matter where management sought to discipline her for reprisal and false actions.  Tripler’s Managers of the Surgical Admissions area have rescinded their notice of disciplinary action.  We will seek all reference to this matter to be purged from her record.

The first of 3 first strike meetings at Hawaiian Dredging was held yesterday.  First strike meeting for bargaining unit personnel in Kona and on Maui will be scheduled take place in the next few weeks.

 Today, on behalf of the membership, I delivered a check in the amount of $5,000 as a political contribution to Maizie Hirono’s campaign for Congress.  The money came from your voluntary donations to the Machinists Non-Partisan Political League (MNPL).  President Bob Lillis has also extended an invitation for Ms. Hirono to meet either with LL 1998’s Executive Board on September 11th or to visit during the General Membership Meeting on Tuesday, September 12th.   

 Remember, no dues are used for political contributions.  These contributions go to political candidates that are “worker-friendly”, regardless of party affiliation.  All members are invited to contribute to MNPL.   All Officers and Stewards normally participate in the Union ’s 10/10 program.  This program consists of an annual minimum contribution of $10.00 to MNPL, and volunteer 10 hours on an organizing or political campaign.  Please let me know, if you are interested in making a contribution to MNPL so we can send you the MNPL envelope.  You can send your contributions to the Union office for forwarding to MNPL’s office.  More information on MNPL can be found on the International’s website at www.goiam.org.

  Our sincerest condolences to Chief Steward Tom Conner (Pearl Harbor Naval Shipyard) and his family on the recent passing of his mother and Brother Joe Waldrop on the passing of his brother-in-law. 

  Congratulations to Sister Lisa Ballard Collins (Army 30th Signal at Schofield) upon the recent settlement of an unfair labor practice charge filed against her Employer.  Supervisors John Balfour and Commander Shah made unilateral changes in changing her work duties and failed to bargain with the Union , made discriminatory remarks and/or other similar actions against her due because of her Union Activity.  The settlement agreement requires she be returned to status quo (i.e., her former set of duties as a Training Manager and a make whole remedy for lost comp time in the amount of 36 hours.   Sister Collins is a GS-12. That classification is exempt under the Federal Labor Standards Act.)  A public posting stating they will not violate the law again will be put up their locations at Schofield, Wheeler and Ft. Shafter locations.  The pending trial has been cancelled.

  Over 100 pages of evidence has been submitted to the Federal Labor Relations Authority in preparation of litigating an unfair labor practice (ULP) charge against Tripler for discriminating against former Chief Steward Greenwood.  Former Supervisors SGT Gales and CPT Murphy in Surgical Admissions discriminated against her because of her protected activity as a Chief Steward for the Dept. of Nursing.  Two examples include -- citing her successful performance as a Union Steward on her annual appraisal; her initial counseling contained items that vviolated the cba and would block her from performing her duties as a Union Steward

  The Army and Navy are intent on no longer offering comprehensive vision examinations for bargaining unit members.  Our team of Stewards at Pearl Harbor and NAVFAC (formerly PWC) are negotiating this matter.  I have the lead on the negotiations with the Army.  I'm very concerned about the bad faith bargaining tactics I'm seeing with the Army on this matter.  In the year 2002, former Chief Steward Mel Lum and I were successful in bargaining to the point where the Army withdraw the same proposal.  I'm asking our teams to use a coordinated approach with regards to bargaining on this issue.  Copies of my last communiqué to the Army have been forwarded to the Stewards by mail.  Please discuss this issue with the workers and members in your area.  I will call a meeting on this issue specifically in the next week. 

  The BAE Hawaii Shipyards members will meet for a status report on negotiations at 3:00 p.m. at the Union Hall on Friday, August 25th.  Boilermaker members are also invited to attend.

  Hawaiian Dredging members are expected to schedule a first strike vote in the next week. 

  We have been approached to organize a local transportation company with over 100 employees.   We hope to report more soon. 

  Mark you calendars - the next General Membership Meeting will be held on Tuesday, September 12 at 6:00 p.m.  Stewards are expected to attend these meetings.  Please make sure all dues paying members are informed and invited to attend.

Looks like the government will not appeal the Judge’s decision on personnel reform similar to NSPS, targeted for Department of Homeland Security personnel.  I will expect a similar response on NSPS for DoD workers.  MORE..... 

So far Hawaii DoD bargaining unit personnel will not be placed under NSPS.  Let’s keep it that way!

Union Negotiations with BAE Hawaii Shipyards commence at 9:00 a.m. on Monday, August 14th thru Friday, August 18 round the clock.  We hope to ratify a new cba by the weekend.  The employees have been represented for over 30 years.  The cba is a joint jurisdiction with the Boilermakers Union.  Our Union has the larger area.  Union’s Negotiators for the Machinists consist of Chief Steward Joe Waldrop, Ruben Mossman, Leland Akamu and myself as Chief Negotiator.  Will keep you posted..

Sisters and Brothers

 Iam on assignment this week in Denver , Colorado , attending the International President's and Western Territory staff conferences.  I will return to the office on June 19th.  Upon my return, I immediately go into a week of first contract negotiations for the members at Lockheed Martin.

Spencer D. Moon, son of Local 1998 member Colleen L. Magdaloyo of Pearl City, Hawaii has won a Union Privilege scholarship of $500 for college.  Sister Magdaloyo works at Pearl Harbor Naval Shipyard.  Best wishes to Sean’s future endeavors.  Locally, the funding for Union Privilege Scholarships come from those of you that participate in the fuel program at Aloha Gas Stations.  A small percentage of the money you spend for gasoline is contributed to the Scholarship Fund.  Please let us know if you’d like to participate in the program.  We will mail you an application. 

Congratulations to Dee Oyama who prevailed in a second step grievance concerning a lowered performance appraisal after she complained of injustices at work.  Sister Oyama is employed at Tripler’s Pharmacy area.

The Retirees Program scheduled for July 11th with Maria Cordone has been cancelled.

Sisters and Brothers,

 I regret to inform you of the passing of former LL 1998 Business Representative Dai Que Kim on May 26th.  Brother Kim was a pioneer in representing federal sector workers.  He was a staunch advocate for workers rights, even in his retirement.  I will miss his visits.  He will be remembered for the quality of his work and dedication to representing our members.    The family will hold private services.  Please join me in sending our condolences to his family. 

 Condolences are also extended to Steward Mike DeLuze (employed at NAVFAC, formerly PWC) on the recent passing of his father on May 20th.  Brother Deluze is also the Conductor-Sentinel on the Local’s Executive Board.

 Congratulations are extended NAVFAC (aka PWC) Chief Steward Larry Nichols and Steward Tom Blanchette in prevailing in a recent situation against the Agency where they had unilaterally imposed a change in past practices where bargaining unit employees were not receiving 4 hours of admin time for blood donation and could take the time in conjunction with 4 hours of vacation time.  The Union had filed a ULP where the Agency had failed to provide information and failed to bargain.  I received word today of the Agency’s withdrawal of their proposal and change in working conditions.  In exchange we will withdraw the ULP.

 A friendly reminder the Lockheed Negotiations Committee will meet with me at the Local on Friday at 5:30 p.m.

Sister Cheryl Pierce has filed a first step grievance against management at the Tripler Health Care Clinic at Schofield Barracks.  The grievance involves failure to pay overtime to a group of nurses that were required to work rotating Saturdays for approximately 4 years.

Sisters and Brothers,

 After several days of intense negotiations, I’m pleased to report tentative settlement of private sector contract negotiations with Raytheon at the Kaena Point Tracking Station. We have reached solid language and economic improvements. The members at Kaena Pont are asked to attend the ratification meetings scheduled for 10:00 a.m.and 6:00 p.m. at the Union Hall – 2428 Rose Street.  The Local’s phone number is 845-1024.  Special thanks to the negotiations committee members:  Grand Lodge Aerospace Coordinator John Crowdis, Chief Steward Wayne Kurakake, Stewards Peter Popa and Phil Pittman. My thanks to all of you that provided research on wages, prayed, emailed and called with your words of support for these members.  I will report to you the final results of the ratification. 

Private sector negotiations at Raytheon Kaena Point will start at 10:00 a.m. on Monday, May 22nd at the Ilikai Hotel.  Their top priorities are wages, restricting increases to medical premiums, improving vacation allotment, and manning levels. All members are asked to support our members these upcoming negotiations.  I hope to call a ratification meeting shortly after May 26th.  Please support our members in these these upcoming negotiations.

Sister Linda Greenwood has just transferred from the Department of Nursing to Department of Family Practice.   I want to thank her for her years of service as the Chief Steward for the Department of Nursing.  This now leaves a vacancy for a Steward within Department of Nursing.  If you would like to volunteer for the vacancy, or to be a Steward in another area, please let me know by emailing me back or calling me at 845-1024.

 I have returned today from having been out sick the majority of last week. 

 Best wishes to Brother Bill Malone who recently retired from Tripler Army Medical Center.

 Congratulations to Stewards Bob Lillis and Genaro Perez for prevailing in 2 unfair labor practice charges where the Agency (1) has refused to arbitrate a grievance filed timely by the Union; and (2) made a unilateral change in working conditions when they took away higher level duties performed by the Nuclear Mechanics.

 Contract Negotiations at Raytheon Kaena Point will commence at 10:00 a.m. on Monday, May 22nd.  My thanks to the Stewards at Raytheon Kaena Point for their initiative in developing proposals and mobilizing the workforce.

Steward Mercy Kealoha recently prevailed in a grievance involving Pearl Harbor Shipyard’s failure to include Mr. Ray Oyakawa in an award given to other Nuclear workers.  The grievance was withdrawn after Mr. Ray Oyakawa received his award.  Good job Sister Mercy!

Union Updates

We have just settled a ULP against Tripler where managers in 4B2 failed to negotiate a proposed rotating work schedule.  The schedule will be rescinded on 4/2/06.  A posting will be disseminated throughout Tripler, and the parties will commence negotiations over the proposed schedule change the month of April. 

Another ULP will be filed against Tripler for continuing to harass Union Steward Linda Greenwood.  They just settled a ULP on the same issue and continued with their anit-union antics.

Brother Craig Morte has been recently appointed as Shop Steward at BAE Hawaii Shipyards.  He’s off to a great start!

We have 2 grievances being processed at BAE Hawaii Shipyards concerning safety and disciplinary actions.  My thanks to Chief Steward Joe Waldrop and Steward Morte for their work on the lower levels of the grievances.  We’ve received a written proposal attempting to settle a termination of another member at the same company. 

The FLRA has scheduled a trial against Tripler for violations of the Act when they unilaterally implemented a rotating work schedule and then by-passing the Union to bargain directly with the workers in 4B2.  The trial is scheduled for the first week of April 2006.   

The Lockheed Martin Negotiations Committee is meeting on Sunday, 3/12 at 2:00 p.m. at the Local.

The BAE H.S.I. Stewards are asked to contact me asap with a meeting date to discuss pending contract negotiations.

The Raytheon Kaena Point Stewards are requested to contact me asap with a meeting date to discuss contract negotiations that will commence in May. 

I will soon call a meeting of our Army Stewards.  Army Stewards are requested to email or call me with dates of your availability during the next week.

Congratulations to Brother Vince Camacho at 30th Signal, Ms. Deena Benefiel in Tripler ICU, and Ms. Diane Enovejas in Tripler Pharmacy for prevailing in their grievances over unwarranted lowered performance appraisals.

There continues to be a steady increase in the number of grievances filed on performance appraisals in our Army units.

We have requested to bargain over a number of mid-term items at Tripler, DPW and Army, 30th Signal (i.e., timekeeping processes, shift changes, rotation of worksites, unilateral change in work duties, Title 38 on-call pay for 3rd wave of new classifications, etc.)

I’m commending Chief Steward Tina Huddleston (Tripler Radiology) for her efforts in negotiations to obtain on-call pay for the Radiology (Ultra-Sound) Technicians under Title 38.  These Techs were the only ones in Radiology that could not be paid the premiums for on-call.  In negotiations, we took the position the Techs wouldn’t work the on-call until management processed their classification for the additional pay premiums under Title 38.  After months of difficult negotiations, we received word last week their classification had been approved for the additional pay.   

A ULP is pending against NAVFAC (formerly PWC) for unilateral change in the policy allowing time off for blood donation.  We requested to bargain about 5 months ago and issued a document request in January 2006 that has not yet been responded to.   Management also appears to be denying the blood time for Stewards only.

Sister Linda Greenwood in SAC at Tripler is under a great deal of discrimination and harassment due to being a Shop Steward.  Please give her your support as we resolve the mess management has created.  Do not let management divide and conquer us by allowing them to talk badly about the Union or a Steward’s efforts to you, or your fellow co-workers!  Stand United!  The members at 30th Signal can attest to results stemming from the strength of their solidarity in recent similar discriminatory incidents. 

DycCorp workers at Hickam have received an extension on their layoff to March 17th.  We presented a second step grievance today with the requested remedy being effects bargaining resulting from the unilateral plant closure.  We were surprised to learn the deciding official, who initially rejected our demand for effects bargaining, did not understand what the term meant.  He may be reconsidering his position.

Kudo’s to Steward Genaro Perez and Chief Steward Bob Lillis for getting management to work on settling a grievance pertaining to additional duties not documented for inspection work performed by Nuclear Mechanics.  In the even the case is not settled, this case is recommended for arbitration.

LL 1998 Retirees’ meeting has been rescheduled tentatively for either March 20th or 21st.  More information to be released shortly.  A 4 hour training by Maria Cordone, Retired International President George Kourpias and General Vice President Lee Pearson on Medicare Part D for Retirees and their families is now scheduled for July 11, 2006.

A ULP has been settled and withdrawn where Steward Linda Greenwood was being harassed by her Supervisors.  The Agency will rescind emails concerning monitoring and statements threatening her license, and will cease from inappropriately directing bargaining unit personnel serve as management’s witness during counseling sessions and/or disciplinary meetings, thereby violating confidentiality of the employee.    

Congratulations to Sister Greenwood on having prevailed yesterday in a grievance where she was reprimanded without just cause.  The matter has been rescinded and expunged from her record.

A final settlement agreement has been reached for Steward Bruce Shimabukuro.  He’ll return to work on March 5th.  He will however be transferred to the Hickam Commissary.  My thanks to him for serving the last 9 years as a Steward at the Pearl Harbor Commissary.  He did a journeyman’s job representing our Union.  His settlement will be approximately $8,000 in backwages, medical expenses, etc. 

LL 1998 Officers are tentatively scheduled to meet with the Local’s retirees at 11:00 a.m. on Monday, March 13th.  More to be announced

We are working on settling a ULP against Tripler where they unilaterally implemented a rotating shift schedule, bypassing the Union and negotiated directly with the workers.  The shift schedule will have to be rescinded in its entirety. Another grievance at Tripler was upheld today involving a Supervisor that was caught fraudulently making changes to timekeeping records.  He then proceeded to retaliate and cause a hostile work environment for the grievant.  Management will take action to correct his behavior. 

Tripler has informed the FLRA of their desire to settle a ULP against them for retaliating and harassing Chief Steward for Dept. of Nursing, Linda Greenwood.  I will keep you informed of this matter.

30th Signal Battalion workers have lodged several grievances and complaints of hostile Supervisors.  One Supervisor is making false allegations to discredit the Union.  Information requests have been submitted to substantiate his accusation of an alleged work stoppage.  I have also demanded to bargain over several of his now daily arbitrary changes in working conditions at the Schofield location.  These workers need your support and solidarity to help them get thru a very difficult time. 

We are in the process of settling another ULP against Raytheon where they failed to provide information.

Negotiations for the Raytheon at Kaena Point location are scheduled for the week of May 22nd.  We hope to negotiate Lockheed Martin COMS unit first cba the week of May 15th.

We have requested to negotiate over the timekeeping process for the Army and at Regional Contracting Hawaii

We are seeing a continued increase in grievances involving hostile Supervisors and lowered performance appraisals.   

I posted and issued written requested nominations for a Steward Election at Range Maintenance, Schofield Barracks.  None were received. 

 Tonight’s membership meeting will be at 6:00 p.m.

Our deepest condolences to LL 1998’s Secretary-Treasurer Larry Taaca on the passing of his mother this week.  Brother Taaca is also the Chief Steward for members working at the Honolulu Advertiser company.

A posting will be distributed by February 10th throughout Tripler Hospital regarding unlawful retaliation against Brother Kevin Saito working out of 4B2 for complaining to the Union about problems at work.  His supervisor (s) will also have to rescind a written counseling letter where they informed him that he was creating a hostile work environment for management when he told them he was going to the Union.  A second posting at Tripler is pending against management in 4B2 for bypassing the Union, negotiating directly with workers on their work schedules after the Union had demanded to bargain.  These are serious violations of the law.  For more information on what is an unfair labor practice charge see www.flra.gov.

 We have withdrawn 3 ULPs against Raytheon at Pearl Harbor concerning unilateral subcontracting and a Supervisor performing bargaining unit work.  We will continue to protest and address the issues in negotiations.  Meanwhile, the company has been served with the Dept. of Labor’s final summary of findings of violations of the Service Contract Act.  We have requested a copy of the document. 

 We are seeing a sharp increase in grievances filed regarding performance appraisals within the Army units. 

 The next membership meeting will be held on February 14th at 6:00 p.m. at the Local.

Aloha,

We offer condolences to Sister Marlene Efhraim-Cruz on the recent passing of her father.  She works at Tripler Army Medical Center. 

We wish a speedy recovery to Brother Mike Kim at the Army’s 30th Signal Battalion.  Due to illness Mike will no longer be able to serve as Shop Steward.  Mike, we really appreciate all that you’ve done as a Steward!

An unfair labor practice charge was filed and amended recently against Tripler for harassing, discriminating and using surveillance tactics against Chief Steward Linda Greenwood.  The Federal Labor Relations Authority (FLRA) is investigating the charge.

Congratulations to Stewards Sam Mitchell and Bob Lillis for assisting a member in obtaining a promotion at Pearl Harbor Naval Shipyard! 

NSPS appears to be delayed again.  As you know, our Union is part of a Coalition of Unions that has filed a lawsuit against the government for failing to substantially negotiate the new personnel system for thousands of Dept. of Defense employees.  Opening statements will be heard on 1/24/06.  See the attached article from GOV EXEC.

I’m preparing a survey to be distributed to non-members dues paying members.  Please let me know if you have any input for the survey.

Aloha Sisters and Brothers,

I’ve just returned from a week-long assignment to our Union’s training center at Placid Harbor.  I’m looking forward to working with all of you on the strategic plan for increasing membership in our federal areas and organizing new units in the private sector arena.    

A few Updates:

Board Charges:

2 ULPs filed against Tripler with the Federal Labor Relations Authority are scheduled for trial in April 2006.  It’s my understanding Tripler has proposed settlement.  You’ll recall these involved (1) unilateral changes in work schedules for the staff in 4B2 (In-patient Psychiatric Unit); and (2) retaliation against Brother Kevin Saito and other employees when management counseled them in writing, telling them they were creating a hostile work environment by going to the Union about problems at work.  These are both serious violations of the law protecting workers that have Union Representation.  2 more charges are pending for continued violations by the same management officials.

5 ULPs were amended and re-filed with the National Labor Relations Board (NLRB) against Raytheon at Pearl Harbor.  The majority of the charges involve unilateral changes in working conditions, harassment, subcontracting of work, and wrongful disciplinary actions against 1 unit member.  We continue to fight for a first contract with the company.  The only outstanding issue is unjustified wage cuts for the 3 most senior employees that also perform the most complex work.  These wage cuts are up to approximately $4.00 an hour.  After 4 years of investigation where we provided the majority of the evidence, the Department of Labor has issued written notice to the company to pay over $200,000 in back pay to the workers that are not receiving prevailing wages.  Raytheon may be sanctioned if they do not comply.  They have ignored verbal requests to do this in recent months.  These are serious violations of the Service Contract Act. 

Althoough DeCA is agreeable to reinstate Brother Shimabukuro at the Pearl Harbor Commissary, they seek unwarranted concessions in exchange for his reinstatement.  Their negotiation tactics are also regressing, instead of progressing.  As such, I will submit the evidence on the ULP where they failed to bargain over his work schedule and will serve notice requesting to arbitrate his grievance. 

Negotiations: 

Commissary workers at Pearl Harbor and Barbers Point ratified their contract on January 12th.  Congratulations to all them! 

DPW Stewards are requested to contact me about a meeting to discuss their contract negotiations asap. 

On Sunday morning, 1/15, I will hold a preliminary meeting with Lockheed Martin’s Labor Advisor and 2 unit members in preparation for their first contract negotiations.  The newly organized unit is very excited about this.

Happy New Year!

We’re starting off the new year on the right note!  On December 4th, Steward Bruce Shimabukuro was wrongfully terminated from his job at the Pearl Harbor Commissary.  The Union filed a grievance and presented compelling evidence showing lack of just cause and harassment by the Supervisor.  The Agency has agreed to reinstate him with a make whole remedy.  We are negotiating the terms of the settlement agreement and project his return date to be 1/8/05.  Congratulations Bruce!
